Terms of Service

These Terms of Service ("Terms") govern your use of Peakly, a service operated by Peakly Ltd ("we", "us", or "our"). By creating an account or using Peakly in any way, you agree to be bound by these Terms.

Please read these Terms carefully. If you do not agree, do not use the Service.

Peakly is a parental assistant service that connects to your email account (Google or Microsoft) with your permission, reads emails from your children's schools, and:

• Extracts key information (events, dates, actions required) using artificial intelligence
• Organises this information into a calendar and dashboard
• Optionally sends you WhatsApp notifications about upcoming events

Peakly reads emails in a read-only capacity. We do not send emails, delete emails, or modify your inbox in any way.

You must be at least 18 years of age to use Peakly. By using the Service, you confirm that you are the parent or legal guardian of the children whose school emails you are monitoring, and that you are authorised to grant us access to the relevant email account.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorised use.

You may connect one email account per Peakly account. Your Peakly account is personal and may not be shared with or transferred to others.

Peakly is a paid subscription service. Available plans and pricing are displayed at the time of purchase. All prices are inclusive of applicable VAT unless stated otherwise.

• Subscriptions are billed on a monthly or annual basis, depending on the plan selected.
• Payments are processed securely by Stripe. We do not store your payment card details.
• Annual plans are billed in full at the start of each billing period.
• Subscriptions automatically renew unless cancelled before the renewal date.
• You can cancel at any time via the Manage Billing section in your account settings.

We do not offer refunds for partial billing periods, except where required by applicable law (including the UK Consumer Contracts Regulations 2013 for purchases made within 14 days of initial subscription, provided the digital service has not yet been accessed).

When you connect your Google or Microsoft account, you grant Peakly read-only access to your emails. We use this access solely to identify and extract school-related communications for your benefit.

We process email content using AI to identify events, dates, and actions. This processing occurs on secure servers. We do not sell, share, or use your email content for advertising or any purpose other than providing the Service to you.

You may revoke our access to your email at any time by disconnecting your account in Settings, or via the Google or Microsoft account permissions page.

Peakly may process information about your children (such as their names and school activities) as part of delivering the Service. This data is processed solely on your behalf and is not used for any other purpose. Please see our Privacy Policy for full details.

You represent that you have the right to add information about the children listed in your account and that you are their parent or legal guardian.

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Attempt to gain unauthorised access to any part of the Service or its related systems
• Use the Service to monitor communications of any person other than your own children
• Reverse engineer, decompile, or otherwise attempt to extract the source code of the Service
• Resell or sublicense access to the Service

The Service and all content created by us (including but not limited to software, design, text, and branding) are owned by Peakly Ltd and protected by applicable intellectual property laws. Nothing in these Terms grants you ownership of any part of the Service.

Your data (emails, child information, calendar events) remains yours. By using the Service, you grant us a limited licence to process this data solely to provide the Service to you.

Peakly is provided "as is". While we strive for accuracy, AI extraction of email content may occasionally miss information or contain errors. You should not rely solely on Peakly for critical school communications.

To the maximum extent permitted by law, Peakly Ltd shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including but not limited to missed events, inaccurate information, or service interruptions.

Our total liability to you for any claims arising under these Terms shall not exceed the amount you paid to us in the 12 months preceding the claim.

We aim to keep Peakly available at all times but do not guarantee uninterrupted access. We may suspend or modify the Service for maintenance, updates, or improvements. Where planned maintenance is significant, we will endeavour to give advance notice.

You may close your account at any time by contacting us at support@peakly.app or via your account settings. Upon termination, your data will be deleted in accordance with our Privacy Policy.

We reserve the right to suspend or terminate your account if you breach these Terms, with or without notice depending on the severity of the breach.

We may update these Terms from time to time. We will notify you of material changes by email or via an in-app notice. Continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.

These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.
